agreements. All software used on the site is the sole property of NVIT, LLC or

TERMS AND CONDITIONS OF SALE
Shipping
NVIT, LLC ships only to location in the United States and U.S. Territories. You
may select your preferred shipping method on the online order form when offered
the option. Shipping charges are indicated in conjunction with the various
methods available. Your order will be processed and shipped at the earliest time
possible following submission of your order.
Orders are generally processed and shipped within one ordinary business day
excluding weekends and holidays. Customers requesting overnight or two day
shipping should contact an NVIT, LLC representative by telephone, email, or fax
before placing their order online to ensure that the order is processed as
quickly as possible. Orders usually arrive within 4 to 7 business days of
processing depending upon the ultimate destination.
All shipping and handling charges are priced at U.S. currency rates. All prices
and shipping rates are subject to change without notice. Our primary couriers
are UPS, FedEx, and the USPS.
Pricing, Payments, and Typographical Errors
All prices for products and services are based in U.S. currency and are subject
to change without notice. In the event a product is listed at an incorrect price
due to typographical error or error in pricing information received from our
suppliers, NVIT, LLC shall have the right to refuse or cancel any orders placed
for products listed with incorrect prices. NVIT, LLC shall have the right to
refuse or cancel any such orders whether or not the order has been confirmed and
your credit card charged. If your credit card has already been charged for the
purchase and your order is canceled, NVIT, LLC shall immediately issue a credit
to your credit card account in the amount of the charge.
Order Confirmation
NVIT, LLC reserves the right at any time after receiving your order to accept or
decline the order for any reason. Your receipt of an email or other form of
order confirmation does not signify our acceptance of your order or confirmation
of an offer to sell. NVIT, LLC reserves the right at any time after receiving
the order to supply less than the quantity of any product ordered without prior
notice. We may require additional information and verifications of the
information you provide before accepting an order. NVIT, LLC reserves the right
to reject any order.
Canceling an Order
You may only cancel items from your order within a reasonable time before they
are shipped. If you would like to cancel items from your order prior to
shipping, please call, fax, or email us at questions @ NVIT.com with the order
number in the subject field as soon as possible. You may also utilize any other
contact method indicated on our contact page.
Returns
SOFTWARE - WE ARE NO LONGER
ABLE TO OFFER REFUNDS FOR ANY SOFTWARE THAT IS PURCHASED AFTER OCTOBER 31, 2002.
WE HAVE DISCONTINUED OUR 30-DAY SATISFACTION GUARANTY. PLEASE MAKE FULL USE OF
THE FREE TRIAL VERSION OF THE SYSTEM TO EVALUATE THE SOFTWARE BEFORE YOU
PURCHASE THE FULL SYSTEM.
PLEASE NOTE: We will only accept products for return within 30 days of
the purchase date. Only merchandise with patent physical defects will be
accepted for return. Defects in the design and programming of software are
governed by the manufacturers End-User Licensing Agreement. Defective
merchandise may only be exchanged for the same item.
RMA - A Return Merchandise Authorization (RMA) must accompany all returned
products. We do not accept returns without a RMA. To obtain a RMA, please use
the contact methods listed on our contact page or email NVIT, LLC at questions @
NVIT.com.
Products and Services Developed and Provided by Third-Parties
Most of the products and services offered through this website are developed and
provided by third-parties with whom NVIT, LLC has contracted. Transactions
between customers of NVIT, LLC and these third-parties are conducted solely
between those customers and third parties. In addition to these Terms and
Conditions, the provision of all third-party products and services are subject
to all additional terms, conditions, and disclaimers made by such third-parties,
or appearing in other pages of this website.
Disclaimer of Warranty and Limitation of Liability
NVIT, LLC ACTS AS A RESELLER OF THIRD-PARTY PRODUCTS AND SERVICES AND ITS OWN
PRODUCTS AND SERVICES, DOES SO ON AN "AS IS" BASIS WITHOUT ANY WARRANTY OR
CONDITION, EXPRESS OR IMPLIED, AND HAS NO LIABILITY WITH RESPECT TO THEM. NVIT,
LLC SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF TITLE, MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT IN REGARD TO ALL OF THESE
PRODUCTS AND SERVICES. IN NO EVENT WILL NVIT, LLC BE LIABLE TO THE CUSTOMER OR
ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, EXEMPLARY, CONSEQUENTIAL DAMAGES,
UNPAID CLAIMS, OR LOST PROFITS (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING
OUT OF OR IN CONNECTION WITH THE PRODUCTS AND SERVICES PROVIDED OR AVAILABLE
THROUGH NVIT, LLC. OUR LIABILITY TO YOU OR ANY THIRD PARTY UNDER ALL
CIRCUMSTANCES IS LIMITED TO AND IN NO EVENT SHALL EXCEED THE AMOUNT OF FEES PAID
TO NVIT, LLC BY YOU PAID IN THE THREE (3) MONTHS PRIOR TO THE ACTION GIVING RISE
TO THE ALLEGED LIABILITY.
Jurisdiction and Venue
You agree that any legal action brought against NVIT, LLC shall be governed by
the laws of the State of Utah without regard to its conflict of law principles.
You agree that the sole jurisdiction and venue for any litigation arising from
your use of or orders made on the NVIT, LLC website shall be an appropriate
federal or state court located in Utah.
